From the government perspective, to qualify as a national government, you must have the corresponding international status. Taipei government, as well as Palestine government, does not have the necessary international recongnition that is needed to be a national government. Taiwan and Palestine all have their freedom for their internal affairs, but lack the international political status. Thus, Taiwan, as well as Palestine, does not qualify as a nation.
From the sovereignty perspective, Taiwan island's sovereignty is in civil war. Japan colonized Taiwan from Chinese Qing Dynasty and Republic of China took it over in 1945. After the Nationalist Party lost the civil war, it shrinked to Taiwan. Sporadic civil wars continued until 1970s. Until now, Taiwan and mainland China are legally still in civil war status. If tomorrow Taipei or Beijing decides to fight, neither of the two sides needs to declare war. South and North Korea have a truce pact, but Beijing and Taipei have nothing and are still in civil war status.
American Constitution is pretty. American Constitution did not give America independence. America won the wars against their mother country Britain, and then got independence. Southern American states tried to get independent in American Civil War too, but failed. If Taiwan wants independence and end the civil war status with mainland China, Taiwan has to learn from American and win the wars against China.
